What is wrong with West Palm Beach’s curfew?
The West Palm Beach youth curfew has so many problems that it would take an essay (or a complaint filed in federal court) to explain them all.
The basic problem, however is this. West Palm Beach’s ordinance explains what constitutes a violation. Directly after that, it explains that anything protected by the First Amendment is not a violation.
Well, according to corresponding caselaw, walking, associating, and talking are all protected by the First Amendment.
So, each time the City issues a citation or a written warning, it is being done so illegally. Further, the curfew ordinance is unconstitutionally vague.
Due to all the ambiguous and sometimes nonsensical exceptions, it is virtually impossible for one to understand what he or she is actually prohibited from doing.
